Top Energy Saver Award - award conditions

This page sets out the conditions of entry for the Top Energy Saver Awards (TESAW).

Top Energy Saver Award - Eligibility Criteria

The award eligibility criteria for a TESAW award is as follows:

  1. The product must be registered and approved by the relevant regulatory authority for electric products or the Australian Gas Association for gas products.
  2. The product must be available for sale in Australia at the time of applying for the award or at some time during the calendar year of the award specified by the applicant. (Note, at the time of registration, all new energy labelling applications have to nominate an "on market" date - this date is used to trigger the appearance of the registration onto the public energyrating website, which also shows whether the product has received an award).
  3. The product must meet or exceed the performance requirements as set out in the performance criteria schedules.

Performance Criteria by Product Type

The performance criteria for electric appliances are set out in Schedule A.

Company Agreement to Award Program Conditions

Companies seeking the Award for specific products are required to abide by the following rules:

  1. Applicants are required to confirm that they agree to abide by these rules.
  2. The Australian Greenhouse Office (AGO) may seek from Suppliers proof of the availability of the Appliance within Australia and failure to supply supporting material will lead to the withdrawal of the Award.
  3. The award eligibility criteria will be reviewed annually by government officials. Award criteria for the forthcoming award year will be announced mid year on www.energyrating.gov.au The eligibility criteria for the forthcoming award year will be valid for award applications made during the period of 1 November until 31 October of the award year (e.g. Award applications made between 1 November 2004 and 31 October 2005 will be assessed against the 2005 Award criteria).
  4. Award winning Appliances, which continue to meet the Award criteria in subsequent award years will be eligible for the Award in subsequent years as long as they meet the revised eligibility criteria. Each year, the Award winning appliance will be entitled to display the new Award label for that year from 1 November in the previous year (eg the 2005 Award can be displayed from 1 November 2004). To secure an Award in subsequent years, applicants are required to re-confirm this declaration for each year that the appliance continues to meet the eligibility criteria and that an Award is sought. During the transition period (1 November 2004 to 31 December 2004) products which have already received a 2004 Award will continue to be displayed on www.energyrating.gov.au New registrations that meet the 2005 Award criteria or existing registrations that meet the 2005 Award criteria and that have their Awards re-confirmed will be displayed as 2005 awards on www.energyrating.gov.au After 1 January 2005 only 2005 Awards will be displayed.
  5. Suppliers must, upon the request of the AGO, provide a fair sample of the award winning Appliance in order to substantiate its claims against those criteria. Failure to supply a fair sample will lead to the withdrawal of the Award.
  6. In the event that subsequent testing of the fair sample of the Appliance establishes that an Appliance does not meet the eligibility criteria, the right to display the Award will be withdrawn.
  7. In the event that the right to display the Award is withdrawn from a Supplier as the result of fair testing, that Supplier, at the discretion of the AGO, may be denied the right to submit any Appliance for an Award in the following year in any category. The AGO may also require test results from a competent independent testing authority before accepting future applications to accompany an Award application.
  8. All information supplied in any supporting material, advertising, point of sale material and user manuals is the responsibility of the Supplier and must be accurate and correct. The relevant regulator reserves the right to request further information at any time regarding the accuracy of data associated with any Appliance. Failure to supply this information to the regulator may, at the discretion of the AGO or regulator, make an Appliance ineligible to be considered for an Award.
  9. The Supplier indemnifies the AGO and their agents against all losses, damages, liabilities, costs and expenses suffered or incurred by the Commonwealth as a result of a claim, demand, proceeding or judgment that arises from or in connection with:
    • any information provided by the Supplier in relation to an Application; or
    • the display of an Award in relation to the Appliance.
  10. While it is the aim of the awards to promote details of TESAW Award winners accurately, no responsibility will be taken for discrepancy, error, omission or misrepresentation that may occur in any media report.
  11. An Application may, at the discretion of the AGO, be reclassified, disqualified or withdrawn at any time if any of the conditions set out in this declaration are not met. Any Appliance category may be withdrawn from the Award system at any time.
  12. The Supplier acknowledges and agrees that the Commonwealth and State agencies which are members of NAEEEP or GTRC may promote or publicise the Award winning Appliances.
  13. The ownership of the TESAW logos remains with the relevant energy regulators and the Australian Greenhouse Office, and use of the logos is subject to the conditions of use set out below:
    • TESAW logos should not be used as part of a trade name or corporation name.
    • TESAW logos must show the correct year in which the Award was issued.
    • TESAW logos must be reproduced in the specified colours, or in black and white.
    • The TESAW logo must only be used to promote the specific appliance model(s) that is the subject of this registration application.
    • TESAW logos should not be used to promote the company, brand or general product range of the company that has won these awards.
